Data protection is already part of everyday life for many - and it also plays an important role in the deployment and use of generative artificial intelligence (AI). This is because personal and sensitive data can be contained in datasets that are then used for training AI models, fine-tuning AI systems or when using AI services. On the one hand, it is important to consider whether these uses have been authorised. On the other hand, how can the protection of such data be effectively enforced in the various processing steps in AI systems? Do the requirements of the European AI Act apply here? If so, at what stage do they apply, and who is responsible for implementing them? Or is the European General Data Protection Regulation (GDPR) possibly far more decisive here? Based on these questions, this issue sheds light on the current state of the debate. In addition, data protection officers report on their day-to-day work advising on the use of AI systems.
