In the December issue of prompt/, we reflect on the past to gain a clearer picture of the future: 2025 saw important judgements handed down in proceedings against AI providers – in GEMA v. OpenAI and Kneschke v. LAION. The decisions had a “signalling effect”, as our interviewee on the GEMA ruling, the renowned legal scholar Prof. Dr Malte Stieper, puts it. Many therefore expect these and other cases to be appealed in the medium term, in Germany to the Federal Court of Justice, and eventually to the European Court of Justice. However, it remains to be seen whether either of these courts will rule on AI and copyright in 2026.

The implementation of the AI Act is equally uncertain. With its Digital Omnibus, the EU Commission wants to postpone previously fixed dates. However, this still has to be approved by the EU Council and the EU Parliament.

In addition to all these reports, we also take a look at what we have planned for next year in our GenKI-IR research project and what we are working towards.
